Legal Question in Family Law in Tennessee

Separated & pregnant

My husband n I have been separated 2 yrs n he has been living with a woman for a majority of the time. I am now pregnant by someone else. I want to give the child my maiden name instead of married name because upon finalization of divorce it is stated I go back to my maiden name but he will not file papers even though we both signed them and they have been notarized. What problems will I face and what are the legalities of this?

You need to seek a divorce from your husband. If he will not sign, then you need to seek an at-fault divorce (or if you have been legally separated for 2 years, then you can proceed under that no-fault ground).
