Seperation questions

My husband and I have been seperated for about 6 years now, though we've never been to court to file for divorce or a legal seperation. I want to buy a house, but I know he has bad credit and owes people money, becuase I was taken to court by one of his creditors a couple of years ago where he had forged my name on one of their documents. If we are not legally seperated, and I buy a house in just my name, is there any way that he or his creditors can try to lay a claim to my home? He doesn't have anything, and I am scared he would try to take my house from me, which is where myself and our 12 year old son would be staying. Thank you.

There are too many variables on this issue. What you need to do is seek a divorce from your husband. If he would consent to it, all it takes is a divorce petition, a marriage dissolution agreement, and a parenting plan. Because you have a child, there would be a 90 day waiting period with the courts once the petition is filed. Feel free to contact our office for more information.
