Legal Question in Family Law in Tennessee

Son wants to live with dad

my 13 year old son, residing in TN, wants to live with me in SC. He asked his mother, and she stated that, after yelling at him, she didnt want to see him a teen one day and a man the next. she hasnt been awarded custody of any of my kids, but so far no others have expressed desire to move here. We are currently divorcing, and I really want for my son to be happy. He has a room and bed here, and in TN he shares a bedroom with 3 other siblings (on cots), he has a futon, and there is an unemployed 32 year old man in the little ramshackle house they all share....what can I do to help my son?

Re: Son wants to live with dad

The first question is to determine which state has jurisdiction, TN or SC. Your remedy is to bring an action seeking custody, but that action must be filed in the correct state.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
