Legal Question in Family Law in Tennessee

out of state paternity

My husband recently received a court order to appear in court to establish paternity of a child with an ex girlfriend. We called and ask to be tested where we live (Missouri) because she lives in Tennessee. The child was born in VA and my husband NEVER lived in TN so there was no reason for him to have to go there. At this point its just he said she said, and the attorney never got in touch with us so we didn't go to court. Did we do the right thing or will my husband get in trouble for not showing up?

Re: out of state paternity

Was your husband served a summons to appear in a Tennessee court and then fail to appear? If so, then the Court might have entered a default judgment against him already. if so, it may not be too late to have that judgment set aside. If not, it may not be too late to have the case against your husband thrown out on the theory that the Tennessee court does not have jurisdiction over your husband, depending upon the law in the state of Tennessee. In any event this is of such importance that you absolutely must hire an attorney in Tennessee to look into this and help your husband if it is not aready too late. Good luck.
