step parent adoption

my ex husband is in jail in tennessee for molesting our daughter. I am remarried and live in florida. how do i find out if his parental rights have already been terminated? my current husband wants to adopt my daughter but out of spite i know my ex will fight tooth and nail to stop it. I recently received a letter from my ex who is not supposed to have any contact with me or my daughter threatening me and saying he wants to take our daughter away from me and have me put in jail for his crime. can we go ahead with the adoption with out having to notify my ex? he has never paid child support but his mother sent money every month up until this past feburary. she has a lot of money and we are not rich people. can you help? thank you.
