Legal Question in Family Law in Tennessee

Step parent interference with visitation

My son, Joe (married now 2 years) had a child (Tanner-5)out of wedlock is constantly being harassed by his ex-girlfriend's husband. He tells Joe when he can see Tanner and when he can't even though the court ordererd him to stay out of the situation and let the parents work it out. Joe recently took his Ex to court to obtain custody of the child due to reports of verbal and physical abuse in Tanner's home. The witnesses were subpoena'd to court to testify of the abuse but changed their stories or couldn't remember what they had been told or witnessed. (Witnesses were a close friend and relative of the ex-girlfriend)

The ex retained custody but her husband/stepdad still calls all the shots. He even tells Joe how to pay the child support and how much. Part of the support goes to Tanner's insurance and the rest goes to Tanner.

The court ordered allows Joe to see Tanner every other weekend and that they are to divide the driving time evenly. (They are 3 hours apart) The stepdad is trying to stop that by saying, ''You're the one wanting to see him so you make the drive both ways''

What can be done to stop the stepdad's interference?

I would have to see the court order to fully answer your question. However, at this point, all I can say is that the parties are ordered to equally divide the driving time and a good lawyer can facilitate that and if the mother does not comply, your son might have to go back to court to enforce the order. Good luck.
