Teen daughter wants to move with me

My teenaged daughter(14 wil turn 15 in oct)has been living with her father who has custody of her.She now wants to live with me but her father doesnt agree.She refuses to leave with him when he is scheduled to pick her up.Can she legally stay here and what can we do to change the order.

You need to file something with the court that established custody in the first place. In Tennessee, a child over 13 can state which parent she prefers living with, but it is not binding on the court. For more info, see www.gsmithlawfirm.com .
