Legal Question in Family Law in Tennessee
terminating parental rights
I have been divorced for 3 1/2 yrs. I have had my child support case for almost 4 yrs. It has been a fight to make him pay all the way he has been arrested a couple of times for this. At the last court date (with child support attorney) he expressed the wish to sign over his rights of the two minor children my question is if he signs over his rights is he still financially responsible if I drop the child support case?

Re: terminating parental rights
I think it is unlikely that a court will allow him to terminate his parental rights unless there is someone else there to adopt him. If his parental rights are terminated, he will no longer be held responsible for child support AFTER the termination. He can still be held for any that he hadn't paid up until the termination is granted.
