Legal Question in Family Law in Tennessee

transportation/visitation

If no mode of travel is specified in the parenting plan, can the custodial parent say no to putting my children on a plane unaccompanied. I live too far away to drive and I am responsible for all costs. If I abide by paying and they are legitimately allowed to travel via the airlines, can she dictate this? She would rather me fly to their state and stay in a hotel to visit them instead of letting them fly to visit my home. Divorce and parenting plan were filed in TN although I now live in another state due to the military.

Re: transportation/visitation

Can she refuse to put them on the plane?

Well, if she does it, that proves that she CAN. She may well be in contempt by doing so, but she can still refuse to do it.

The best approach is to try to resolve this dispute by agreement, or mediation, or by going to court to have the language on the issue clarified instead of allowing the situation to go on so you miss your time with the children before initiating anything in court.

If you have any questions, contact the attorney who last handled your case, or call me and I will be happy to discuss the specifics by phone.
