Legal Question in Family Law in Tennessee

Visitation with joint custody

Can a parent keep the child from seeing the other parent because child support isnt being paid at the time because not working or its late? Does child support still have to be paid if becoming at home parent and if so is there a way to pay it by deducting from husbands check (not childs father)?

Re: Visitation with joint custody

Child support and visitation are independent of each other. The custodial parent can not deny visitation because support is not being paid and the non-custodial can not suspend child support because visitation is being denied.

The remedy for either such parent is to file a petition for contempt.

Child support is still owed even if the parent stops work to stay at home, and I am aware of no provisions for a wage assignment against the spouse of the non-custodial parent.
