Legal Question in Family Law in Tennessee
Hello. My wife had sex with another man while I was deployed. I have two questions First if we get a divorce will I get everything, and would if we stayed together and I got her to sign a document saying that if she done it again I would get everything would it hold up in court? We live in TN and was married in VA if that helps.
Respectfully,
A Soldier

adultery certainly gives you grounds for divorce, but it does not mean you get everything. It is possible to enter into an agreement that sets out the distribution of property, etc. This is commonly referred to as a Postnuptial agreement and it will generally hold up so long as it is competently and accuratley preperared. There are some pot holes you can fall in though with these documents so you need to make sure you employ someone that is very competent in this field so that it does indeed stand up if it is ever needed.
