Legal Question in Family Law in Tennessee

Writing the Judge

I have been in a child support case for a very long time, during the beginning of the case the judge asked for the tax information from the non-custodial parent, this was in June of '08. We have had three court dates since this request was made and still no tax information.

I have just become aware that the judge is not aware that we do not have this tax information, and my attorney has not made her aware of it. Should I write a letter to her on this matter, I do not want to get into court on the next court date and have her reset the date again because we do not have the information she requested.

Re: Writing the Judge

Once you are represented by an attorney, you are represented by the attorney. Any contact with the Court is to be by your attorney, and no one should ever contact the court in a pending case without the other side being informed and getting a copy at the same time.

Letters such as you suggest are not only not read by judges, it often offends judges when they are sent and hurts the person sending the letter.

If you are concerned about the records, speak with your attorney, do not try to contact the court.
