Are written and/or verbal agreemwnts binding
If two parties have a written and/or verbal agreement as to which parent will claim which children for tax purposes, is that agreement binding in court?

I believe you will find after speaking with your CPA that the answer is "no." IRS rules state who can take the deduction. The parties can agree in writing and the court may alter the rights between the parties, but I believe you will still need to fill out appropriate IRS forms to take a duction/exemption not already allowed to you by the existing regulations. Contact your CPA before you make any decisions along these lines. Good luck.
