Legal Question in Family Law in Tennessee

X Makes Threats about custody and child support to child

I was divorced in Feb of 2003. I have sole custody of our 15 year old daughter. I was not at the hearing because I couldn't afford it. Now my daughter and her father are not getting along. In the order he can't ''bad mouth'' me and he has been threatening to stop child support and to ''take'' her away from me to ''her'' over the telephone. His reason is because she called him a liar and a (SOB). He said if she does it again he will take her away and or stop child support. Its funny because he hasn't even seen her for almost 9 months now. He has missed several court odered visitation days too. Can I take him back to court in my State of TN? Or do I have to go back trough his State of IN. from where the divorce took place? I need help please....

I wouldn't worry about threats until he follows through. However, you may want to consider having an attorney look over your divorce decree and see what can be done. Usually custody matters revert back to the court in which they originated. Therefore, you may have to go back to court in IN to enforce a decree, unless you choose to have the decree transfered and entered in the Tennessee state courts.
