Auto accident with no accident report

My wife had bumped a woman going 2-5 miles and hour in a parking lot. The police were called and said they would not wirte an accident report. The other driver took picture and took my wifes name and number. There was no other conversation other than the other driver being very hateful to my wife for being hispanic. The other driver is suing my wife for $4160.00 and for '' Failure to pay '' ''Breach of Promise'' and ''Common law''. What are my wifes rights? What should I use to defend my wife since there was not a police report written to determine fault? Any help will be appreciated..

You will really need to show the complaint to an attorney, before he can prepare an answer. If the pedestrian was not injured, then what would account for $4,000+ in damages? This sounds like extortion and would make me want to file a counter-claim against the Plaintiff.
