Damage during valet parking
We used the Marriott (Memphis Downtown) valet service during a recent stay in TN. We drove a brand new car we had just purchased the day before. We are certain that there was no damage to the car prior to the Marriott. The car stayed garaged our entire trip (brought out once by the valet so that we could retrieve items). When we left, it was pouring rain and it rained pretty much nonstop all the way home. We spent one night at a family vacation home in NC where there were no other cars parked and are quite sure the car did not receive the damage in our possession. The morning after we arrived home, I took my car through a laser carwash. We towel-dried it and were dismayed to find the front of the hood and grill scratched as if it were driven up under something. There was also a small ding on the driver-side door. I have contacted the Marriott and was transferred to the Valet Service (for which we paid $18/day). I was told that the individual in charge would call me back tomorrow. Please educate me as to our rights.

I am not suppose to respond to any legal questions unless they pertain to South Carolina. I will make a limited exception however in your case since your the first person in ages that knew how to communicate in English, use correct spelling, grammer, and was polite. It sounds like the valet service is responsible and I would hold them to it. Howver, if this case went to trial and I was the attorney defending them, I would make it real real clear that you just don't know for sure. That is a limited answer to your question. Please cut and paste your question and resubmit it under TN as there might be something unusual about that state's law that I am not aware of since I am only licensed in South Carolina.
