Illegal Immigrant Killed My Husband

An illegal immigrant, driving without a license, failed to yield at a flashing red light, and hit my husband, killing him. The car she was driving was not her own. The police did not get insurance info. from the car owner. The woman driving was only given 30 days probation for driving with no license. Why no charge of vehicular manslaughter, and why no deportation? How can I find out if car owner has insurance? Can you even sue an illegal immigrant?
