H1b filings
An h1B petition was filed on April 1st 2008, this was under Masters quota and 20,000 cap. After the lottery I have not received any notification from USCIS, not even the receipt number. Its June 5th and my attorney said that the chances that I made the lottery are slim.
Meanwhile I have received a University job offer which I plan to take. Can the University file an H1B petition, before I get any formal (rejection letter/ packet return) from USCIS. Currently I am on F2, if the University goes ahead and files the H1b, but it also turns out that the other H1B got approved, will I run into immigration status or legal issues.

Yes...university can file. It is unlikely that you got a visa number from your first application.
