IMMIGRATION ISSUE

Hello, i am an immigrant in the USA. I came here in 2006 on a F1 visa. I will be 28 years old in March. In 2007 i went home to Kenya in December where i renewed my visa and i came back in January 2008. When i came back i didn't not go back to school due to financial issues. Last year around August i was contacted by immigration authority and i am now in the process for removal.

I do not want to go back to my home country Kenya due to fear of physical harm due to my tribe (ethnic group). My country has a bad history of terror during election seasons. At the last elections their was a lot of killing and bloodshed especially between the Kikuyu (my tribe) and the Luo because the 2 main presidential candidates were from these 2 tribes. The case is currently being heard at The ICC at the Hague. Their has been violence in past elections as well. When i went home to visit, even after the elections i experienced physical harm by government police who locked me & my brother up for the night and tortured my brother & i due to our tribe. The Kenyan elections are starting in March this year and my hearing is on May 4th. I fear going back and being attacked again. All of my other male family members have moved to different countries (my dad in Rwanda & brother Uganda) for safety.

My questions, first, can i apply for amnesty and if not, what other options due i have.

Second, i am already in immigration proceedings. I have filled out the amnesty paper work and provided documented proof to go with it from websites and newspaper periodicals, but i have been told that i have to have a lawyer physically present them to the judge on my court date. I wanted to know if it would be okay for me to go ahead and send a copy to the US department of Homeland Security Bureau of Citizenship and Immigration Asylum office in TX. I heard that sending a copy may make my case worse or be worthless or make it look like i'm being desperate.

You really need to obtain legal representation if you are in Removal. This issue is far too complicated to give you a little advice over the internet.

I recommend you find an attorney that has experience with asylum and related issues, as well as Removal.
