Legal Question in Immigration Law in Tennessee

Maria came to america 8 years ago on a tourist Visa, Maria overstayed her Visa and became Illegal. In May Maria gets Married to Joe and applies for a Temporary Visa and a Social Security Number. Six months later, Maria wants to divorce her husband Joe (American Citizen) and Marry Steve (Steve) Steve is an American citizen by birth and he makes about $40,000 per year. Is this going to complicate her application process for a permanent Visa? Will Maria need a lawyer and if so, how much will the lawyer charge?

I would need to know what this "temporary visa" is because it sounds as if she may have applied for an Immigrant visa. so long as there is no evidence of fraud involved in the case, the adjustment could potentially be re-filed through the new husband. feel free to contact my office for an appointment via phone. the intiial consultation fee is just $80.

It is not clear from your post what type of temporary visa Maria had, if she is now divorced and what her previous immigration history is. All of this is relevant with regards to determining her eligibility to apply for permanent residence through Steve. She should definitely consult with an attorney regarding her previous immigration history (including the temporary visa) before filing anything with USCIS.
