Hit and Run Accident
After being the victim in a hit and run accident, what rights do I have to go after the individual from a civil standpoint, or must I just wait on the Insurance Company, when they are surely not working for my personal interest?

From the wording of your message about being the victim of a hit and run accident, it appears as though the insurance company you are referring to is your own uninsured motorist insurance coverage. You have one year to file a lawsuit for personal injuries in Tennessee. In order to settle with an insurance company, they need to see your medical bills. It can take quite a bit of time to get your medical bills together. In addition, if you have serious injury, you need an impairment rating from your physician. If you have not yet reached maximum medical recovery, the physician cannot provide an impairment rating. In the meantime, the one year statute of limitations to file suit is running. The insurance company will try to settle the case for the smallest amount of money possible. The insurance company is not going to tell you about impairment ratings. The insurance company is not going to tell you about future medical bills that you might have. In a nutshell, the insurance company wants to settle quickly if they can get you to settle for a small sum. The adjuster is experienced at doing this.
