Legal Question in Insurance Law in Tennessee
Wreck results in a dealer owned vehicle. Who Pays?
I had an accident in a dealer owned vehicle that I drove home while my new truck was being ordered. The dealer would not let me drive the trade in vehicle back off the lot. I had an accident which resulted in my fault. What Insurance Co. pays? The dealer insurance company or my insurance company? Please respond.

Re: Wreck results in a dealer owned vehicle. Who Pays?
The dealer owned vehicle is the damaged vehicle. Therefore, the dealer's insurance will pay for that damage with a subrogation lawsuit being filed against you by the dealer's insurance for negligence. Your trade in vehicle insurance would still be in effect to cover property damage but you need to read your policy to see how liberal its coverage would be in a situation such as yours.

Probably both depending on the language of each policy. Most likely the dealer's insurance carrier will come back on you for contribution.
