Legal Question in Intellectual Property in Tennessee

Billing Data

Does a company that provides billing and collection services to healthcare providers, have to give up their computer data when the provider decides to do their own billing or go to another billing company? Note: the billing company produced all computer data from paper media

Re: Billing Data

The answer to your question is a resounding IT DEPENDS (totally unsatisfactory, I know). The questions involve ownership of the database, "work made for hire" agreements, and other such things that you didn't clue us in to.

You should speak with your INTELLECTUAL PROPERTY (not general) attorney about this matter. If you need a referral, check with your local bar association, or select a local lawyer from the roster of attorneys that you can find at https://oedci.uspto.gov/OEDCI/ (registered patent attorneys and agents; make sure the person you contact is an ATTORNEY; agents are not allowed to handle copyright and trademark matters, which your question calls for).

THE INFORMATION PRESENTED HERE IS GENERAL IN NATURE AND IS NOT INTENDED, NOR SHOULD IT BE CONSTRUED, AS LEGAL ADVICE. THIS POSTING DOES NOT CREATE ANY ATTORNEY-CLIENT RELATIONSHIP BETWEEN US. FOR SPECIFIC ADVICE ABOUT YOUR PARTICULAR SITUATION, CONSULT YOUR ATTORNEY.
