Legal Question in Employment Law in Tennessee
Alcohol in the workplace
If an employer provides alcohol in the workplace on a regular basis, and does nothing to reprimand employees and supervisors who drink ''on the clock'' and drive--can they fire an employee for getting a dui?

Re: Alcohol in the workplace
Generally, Tennessee is an at-will jurisdiction, making the short answer to your question, probably yes. What this means is that in Tennessee an employer can fire an employee for good, bad, or no reason at all, even for a reason that is morally wrong. What the employer cannot do is discriminate or retaliate against anyone in the termination of his or her employment.
