Does the aveage joe have rights?
Hello,
I was involved in a truck accident on 4-03. I was out of work for 5 months. The other person was at fault. I hired a lawyer to handle my workman's comp. case. My problem is I went back to work on 9-15-03. I told them after almost 8000 miles in 2 week I needed a rest. I was wore out, also had no more hours of service to run. They fired me. I couldn't believe it. I've never had a problem with them in the 16 months I've been there. They gave me my termination paper with no previous displinary problems. I applied for unemployment and was awarded it, The employment office said my previous employer lied to them about my previous miles amount, they said I ran 2200 in 2 weeks. The lawyer that I have doesn't handle labor law. He gave my some other to call. When I talk to them, they won't handle it cause they didn't get the workman's comp part too. Other employers said the first chance they were going to get rid of me. I didn't ask for the other fellow to hit me, nor did I ask to stay out for 5 months. I'm a hard working father of 7 and the only source of income for my family. I tried to talk to my former employer, but they were really unreasonable about it. I've never had a problem before. Do I have any rights?
