Legal Question in Employment Law in Tennessee
Contract Labor
I have a contract with an individual who cuts hay for me. He uses his own equipment and sets his own hours. When he buys my hay from me, he pays me out of his business account which lists his business name, address and phone number. I will have to pull the contract to see if it lists his business name. He told me a rock flew back and hit his tractor door breaking the glass. He said that I owe him the repair bill and that he will be presenting me the bill. I believe as in independent contract labor hired, he has the responsibility for his own repairs and assumes liability for damages as he is in business for himself. Do I have any legal obligation to pay for his repairs? I have not agreed to pay for any repairs by verbal or written contract. Thank you.

Re: Contract Labor
From your description it seems likely that you will not have an obligation to pay the repair bill for his tractor. You may want to ask him why he thinks you owe the repair bill since it is his tractor that he was using to cut what would become his hay.
