Legal Question in Employment Law in Tennessee
Contract or not?
I recently became employed at a job where, before starting, was asked to sign a paper that said if I left within the first year of employment, I would be obligated to pay them $500 to reimburse for training, uniforms, etc. No one from this company signed it as well. Is this legal? Anyway around it?

Re: Contract or not?
Agreements of that type are generally enforceable if they are properly written and performed. Without seeing the contract it is hard to say if that particular agreement is unenforceable.
Such agreements must be support by consideration. If the agreement is used as a legitimate condition of employment, then it is supported by consideration. If there are other people in your organization who have the same or similar job as you and were not required to sign the Agreement as a condition of employment and those folks were hired at the same time or after you, then you have a good argument the Agreement lacks consideration.
I hope this helps. If you have any more questions or would like me to take a look at that Agreement, please contact me at 800.403.7868 or [email protected].
