Legal Question in Employment Law in Tennessee
Defamation of Character on the job
What proof does one have to have in order to prove defamation of character? And, what might be some of the remedies? I have been an employee with the same company for 15+ yrs. In that time, I have done exemplary work and have never been in trouble. We have a supervisor who is less than professional. I was demoted on 3 instances in 3 months because she led her superiors to believe that I was dishonest in my job duties (accounting clerk, customer service clerk, and payroll clerk.)I have never done anything dishonest as an employee for this company. I did not lose any pay or my job, but these untrue allegations could very well have caused my dismissal. Do I have any recourse?

Re: Defamation of Character on the job
The sort of scenario you have briefly outlined is less likely to be a defamation claim (primarily because defamation requires publication to a third party, which has not occurred) and more likely to be a prelude to a removal action. This will be actionable in Tennessee only if the underlying reason for the demotions/dismissal is discriminatory and/or retaliatory.
