Distribuiton of flyers on company property

We are attempting to organize a Union at my jobsite. My employer has forbidden the distribution of any flyers on company property. He claims that we are soliciting and he has a no solicting sign posted at the entrance of our parking lot. Can he legally prevent us from passing out Union material on the lot as long as we do it on non work time by characterizing it as soliciting?

No he cannot prevent it in that fashion. He can put some limitations on your ability to campaign on company premises. Does your union have a professional organizer? Does it have a lawyer? The union should be notified of the employer's tactics and it can and should fight unfair labor practices as they arise.
