Can I force an existing employee to sign a non-compete agreement and if so and they refuse to sign then what are my rights as to termination of employee?

In Tennessee you can require an employee to sign a noncompete. Further, provided you are consistent, you can fire the employee for refusing to sign.
However, a different but equally important question is enforcability. You will want to sit down with an attorney to talk through what you are seeking to protect and how you are doing that.
