Legal Question in Employment Law in Tennessee

Employer appealing unemployment hearing decision

I was terminated from my job due to a one-time error of judgment. I filed for unemployment benefits and was approved. My employer appealed and I went through a hearing. This hearing was also decided in my favor and I continue to collect benefits. Now, my employer has appealed to the Board of Review, so a hearing may or may not be scheduled. What is the likelihood that the employer will get the decision overturned in their favor?

Generally, the further your case goes, the more difficult it is for the losing side to reverse the outcome. Typically, before the Board of Review an employer would have to show that there was some new evidence or that the decision was contrary to the weight of the evidence. This is a pretty heavy burden to meet.
