Employer let health insurance lapse, still deducts premiums from pay

My employer let the health insurance lapse (failure to pay premiums) and claims are being denied. He still deducts insurance premiums from our paychecks and has told no one about the lapse. I found out because of the denial of a submitted claim. What recourse do I have?

You and your co-workers have a claim against your employer under the ERISA Act which is a federal law covering employee benefit plans. You may also have a state law claim for fraud or breach of fiduciary duty.

The tpye of claim you describe sounds very serious. You should act on it immediately.
