Employment Contracts

In 1998 I began employment with Hy-Tech Wholesale. This company was involved in wholesale sales of computer hardware components and computer systems to local computer stores and independent computer consultants for re-sale to the general public. In 1999 I signed an employment agreement with Hy-Tech Wholesale in which I agreed not to accept employment with a direct competitor of Hy-Tech. Sometime later in late 2000 Hy-Tech began changing its marketing focus to include corporate, education and government accounts. At that time Hy-Tech introduced a ''new'' employment, much more detailed. I did not sign that agreement nor was ever asked to. After leaving Hy-tech I have taken a position with a company that primarily sells Point of Sale and restaurant systems. As part of my duties I assist my new employers existing customers with computer hardware sales. I have never solicited any business from my former customers at Hy-Tech Wholesale. Hy-Tech is now filed suit against me for breach of my employment agreement. What should I do?

You need an attorney. These cases are very fact specific. Your email contains a lot to work with. These cases can usually be negotiated to get everyone where they need to go. Your new employer may be willing to pick up the cost of an attorney if you ask them.
