Legal Question in Employment Law in Tennessee
Employment termination
I was working in the business office of a nursing home for 3 1/2 years. A new management company took over in 2006 and I was under a new supervisor in 2007. This was a 2 person office (the supervisor and me) and the all of the A/P, A/R, payroll, insurance filing and collections fell to me because the new supervisor knew nothing of long term care. Before I went on vacation I had permission from my supervisor to work overtime; when I returned I was fired for working overtime by this same supervisor. I appealed the company's denial of umemployment benefits and won. I have been on numerous job interviews in the healthcare field for which I am very qualified but the termination is a hurdle I can't get over. Do I have a libel suit for damages stemming from this termination?

Re: Employment termination
It depends on what the former is telling prospective employers. Generally, job references are going to be protected and not the subject to a lawsuit. However, in some instances, that protection can be stripped away.
