Legal Question in Employment Law in Tennessee
I am a home health RN and have recently found out that the other RN who has the same job as I has been getting paid more that I do. I have been with this company for almost 4 yrs. and she has only been here but about a year. Our boss tends to 'baby' her alot. Is it illegal for them to pay her more for doing the same job? or do they have a right to pay whatever they want to whoever they want with the same job title?
1 Answer from Attorneys
It is possible they could pay people different amounts for the same work. It is also possible that this conduct could be illegal. A number of factors go into determining if (1) the workers are truly equal and (2) whether or not the conduct is illegal. If you have a concern that you are being treated illegally, you should consult with an experienced labor and employment law attorney to discuss these issues.
