Legal Question in Employment Law in Tennessee

Inappropriate Conduct at Work

I worked for Advance Auto and my daughter came in and applied for a job.On her application she put her new cell phone to be contacted only for a job. Instead the Asst. Manager took the information and called her for other reason .He's married with 3 kids.He was comming on to her sexually at late hours and on company time. Reported it to my safe work place and the company swept this under the rug, because he's well liked by higher up officials. My Store Magager quit for a better job and this left the Assistance as the acting Manager. He was let go from another job for sexually harassment, and was caught on tape at our store for other conduct that was inappropriate.

Re: Inappropriate Conduct at Work

You need to review your company's sexual harassment policy. Typically, it forbids harassment of not just employees, but also customers and job applicants. In this case, after reviewing the policy, follow what it says in terms of making an official complaint of sexual harassment.

A couple of things to make sure about in your complaint. First, make sure that it is in writing. Second, make sure that it is detailed in the description of the misconduct and labels the misconduct as sexual harassment.

Making a complaint of harassment should grant you job protection from retaliation. However, it is sometimes difficult to prove that retaliation was the motive for the adverse action. Given the situation, you do not want your daughter to be the subject of this type of conduct and this is the action that will give you the most protection in acting.
