Incentive Compensation
I have an employment contract (in writing) that states that I will receive a ''base Pay'' + up to 20% in incentive compensations paid both quarterly (10% personal MBO's) and annually (10% company). To date I have never had an evaluation, given any MBO's,or received any of this compensation. I have been employed nearly 6 years!
The Company stated that no one was getting ''bonuses'' so I did not fight it. However, I recently found out that one group continued to receive their incentives because it was leveraged as ''part of their compensation''. Further, I was told that I was no longer on this plan. Do I have any options here? My contract does not define this compensation as ''bonus'' and I was never notified that my compensation plan was changed. The maximum lost compensation is well over 150K.

You may have a legitimate claim for the unpaid bonus. However, without looking at your contract, it is impossible to give you any more definitive answer. I would recommend that you have an attorney look at the contract to give you an opinion and to discuss your options.
