laid off policy broken,unfair

myself and 8 others were laid off due to' elimination of our job titles'. We were not offered jobs on the production floor although past practice and policy was to eliminate temporary workers to keep permanant ones.Many temps are there working.

Senority ploicies were also ignored. Two persons got to go back to the floor, whom had less senority than I.

Many polocies and past practices, not followed. we tried to get a union in and they are targeting the vocal union supportors. help????

Your situation raises a number of issues: 1. There are protections for workers who excersise their rights for collective action. The employer cannot retailiate against you for trying to organize a union. 2. Because you raise the issue of senority, age discrimination might be an issue. An employer cannot make employment decisions on the basis of age or engage in conduct which adversly effects older more senior workers in a disporportiate manner. If there are policies or practices which the employer used before and does not properly provide a basis to depart from them, there may be recourse for you in that event. There are also other basis for action depending on the specific circumstances of your situation. You should seek help from an experienced employment lawyer quickly. Time is not on your side.
