Legal Question in Employment Law in Tennessee

Legal remedies for termination without just cause

My brother was denied unemployment benefits, he appealed the denial and won the case. In the appeal process it was discovered that the employer was terminating him because he missed work on 3 occasions without notifying the company. After review of the evidence it was found he made attempts to call someone and left messages for his supervisor and their personnel department, and the company stated he missed work one day but he had a pay check stub to prove he worked everyday that particular week. My brother has been so nervous about this that he has gotten real sick and had to go to the emergency room. He did not get his job back. Are there any other legal remedies he can pursue?

Re: Legal remedies for termination without just cause

If your brother worked in Tennessee and was the victim of discrimination or unlawful retaliation, then it may be possible to have some type of legal remedy for the termination. Otherwise, Tennessee is an at-will state and an employee can be fired for good, bad or no reason at all.
