Legal Rights of Discloser

The Question is a two parter: 1. As a prospective employee what are my legal resposibily as to how much information I must give on an application, for example if I have been terminated or not? I understand that the prospective employer has the right to do a background check that may reveal such information so is it better to be up front on the aplication? 2 As far as the background information what legal rights do I have to that information and how do I request and attain that information for free?

You must be honest on your applications. If the application or the interviewer does not ask you a question to elicit the kind of information you are concerned about there is no obligation to bring it up yourself. However, you should consider whether or not it is better for the employer to hear your side of the story before he finds out about a termination or other similar issues/facts from your previous employer.

There is no right for you to get copies of whatever background check they do on you.
