non compete agreements

I currently work in the staffing industry. However, I do not agree with the direction that the company is currently going in and am considering opening my own firm. I signed a non compete several years ago with my current employer. They are big--in the top 5 in the world! Can you please tell me if non competes are legal in Tennessee? If so, how many companies go after former employees who open their own business.

Non compete agreements are legal and enforceable in Tennessee. Courts will not enforce them unconditionally. The company must provide a business reason for the enforcement and the agreement can only be enforced to further that legitimate business need. There are ways to defend enforcement of these agreements. Each one is different.

Most companies who use non-compete agreements enforce them. Each company has its own philosophy on how they enforce the agreements and which cases they will bring in court. You should see an attorney who is experienced in non-compete cases to evaluate your specific situation.
