Legal Question in Employment Law in Tennessee

Reference information

I was fired from my job and think it was an unfair firing. If I use this company as a reference to my next job, what kind of nformation are they allowed to give to my ''new potential'' employer? What types of information can and cannot be legally told from a prior employer?

Re: Reference information

Generally, an employer is going to be given wide latitude in what they can tell a prospective employer. However, as a general rule, most employer's do not want to expose themselves to the risk of litigation from saying too much and limit their statements to dates of employment, salary and whether or not you are eligible for rehire.

In a situation like this, you may be best served by consulting with an attorney to discuss your situation. There are ways you can approach the topic with prospective employers and you may have some leverage to negotiate a specific recommendation from your former employer.
