Legal Question in Employment Law in Tennessee

slander/libel

I have 2 questions actually. First, if members of management discuss my job performance in a negative way to others outside the agency that I work for, would I have grounds for a slander suit? Secondly, if I was promised a job through verbal agreement, and quit my current job just to find out that the agency had ''changed their minds'', would I have grounds for a lawsuit? Additionally, what is the general law regarding management discussing anything about another employee to someone who is not in management? Any information would be useful. Thank you

1. Depending on all the facts and circumstances you could have a claim if: 1. If the negative things they said about you were false; 2. Someone outside the agency heard those statements; and, 3. You could prove that you were acutally damaged because of the false statement. There are many ways to be damaged, the most obvious if the person who heard the statement refused to hire you because of the statement. Proof of actual damage in these types of cases is usually the hardest element to prove.

2. Depending on all the facts and circumstances, yes, you could have a claim if you quit your previous job in reasonable reliance on the statements made by the potential employer.

Keep in mind that each case is different and your case will depend greatly on exactly what was said, to whom and why.
