Legal Question in Employment Law in Tennessee
Training Contract
I started working for a retailer in 2002. In 2004 I signed a 5 year Training Contract with this company when I went into their asst mgr. Training Program. The contract was for $5,000 and it would take off $1,000 for each year worked. When presented with this contract the Corporate Trainer went over the it with me and he said, the reason why they have a contract, is so that after I am trained I won't leave here and go to another retailer and work for them after they spent money to train me. In the contract I also remember that there was a clause that stated (paraphrasing) ''I do not have to work for said business for any certain amount of time.'' The corporate trainer at that time, also did say ''between me and him'' that no one that he knows of has ever had to repay any training dollars from this contract. So my question is, I am no longer with this company as of 7/8/07, and they sent me a letter today stating I owed them $3000 for a refund of training. is this true or are they just trying to scare me into paying then? I did not go to another retailer and I did give 2wks notice and they never said I was breeching my contact when given my 2wks notice. Plus, others have said they didn't have to pay it back, Can anyone help?

Re: Training Contract
Each of those types of contract are different. Without legal help, you will most likely have to repay the money. There are basis to defend those cases if other folks did not repay the money. It also depends how and why you left.
