Tuition repayment to former employer

I was reimbursed for tuition by company ''X''. I signed an agreement to repay company ''X'', and only Company ''X'', any tuition reimbursement if I left within one year of reimbursement. Company ''X'' was then acquired by Company ''Y''. The tuition reimbursement agreement does not mention a successor or assign, even generically. I have since left company ''Y'' and they want to withold my last few paychecks for tuition owed to company ''X''. Company ''X'' no longer exists. Can I be bound to company ''Y'' if the reimbursement agreement does not mention their right to collect the reimbursement?

An attorney would need to see your tuition reimbursement agreement and any related documents before being able to advise you on this issue. As a general rule, most of these types of agreements are assignable to successor employers.
