Legal Question in Employment Law in Tennessee
Unemployment
My employer has given me a 30 day notice. They are attempting to ''place'' me in a different positon in the same facility with approximately a 30-40% pay cut, with a move from day shift to night shift, and worse working conditions. I have been with this employer for over 14 years and the only reason for this change is the elimination of my job position. Can I file for unemployment benefits or can they force me to accept this proposal?

Re: Unemployment
Since they are not offering you the same or a similar position, I do not believe that they can sucessfully oppose your attempt to get unemployment benefits.
Keep in mind that any time positions are eliminated either individually or as part of a larger reduction in force, the company cannot take action that unfairly impacts a protected group. You may want to consult with an attorney if you feel that the company may have eliminated your position because of your age, gender, race, national origin or other protected characteristic.
