I am in the mortgage industry .I left one employer and went to work for another employer in the same industry.With the new employer I called a client I had previously tried to provide a loan to with the previous company.I was not able to complete a transaction with the previous company for the client because the client was ineligible for the product that my previous company offered.I am able to complete it with my new employer.The client is someone that I had found on my own while working for the previous employer and was not provided by them.The previous employer discovered that I was working with the client and contacted me telling me I could not work that client through my new employer because I had started the process with them.My question is if I did not sign a no compete clause and I did not work a client that they had provided and it has been over 90 days since the initial contact with the client do they have legal recourse if I don't complete the loan with them if they did not provide the client and was not able to complete a loan for them at the time of the solicitation ?

In the absence of some contractual agreement (usually a noncompete agreement), there is usually no prohibition upon competition in Tennessee. You need to bring this issue to the attention of your new employer so that you do not jeopardize your new employment.
