Legal Question in Employment Law in Tennessee

Working Holiday and excessive overtime

My Finance department has been required to work Holidays along with excessively long hours. We have been told that as exempt employees we are required to work both Holidays and as many hours as required. Sometime 12 - 17 hour days weeks in a row. On several occasions Sundays have been deemed a workday even as concerns about religious observances have been raised. As an exempt employee do I have any protection?

Re: Working Holiday and excessive overtime

It may be that you are entitled to overtime compensation. The Fair Labor Standards Act defines what employees are exempt and nonexempt based upon their job duties, not titles. This is a common misconception among both employees and employers. However, the analysis of whether or not your position is properly classified as exempt it too lengthy to take up in response to your posting. In order to properly evaluate your situation, you need to contact an attorney who handles a significant number of FLSA cases and schedule a consultation with him or her.
