If I am renting a home that I recntly find out has lead based paint because my children ages 3 and 6 tested positive for lead poisoning can I take legal action?

The State Department of Health maintains the health and safety standards over rental property. Your landlord has to maintain the property within these standards - otherwise, the health department can declare that the property is unfit for human habitation.
The "legal action" you can take is to contact the health department in your town/county.
