This is difficult to answer without knowing more facts about the potential case. Generally in Tennessee there is a one year statute of limitations for medical malpractice. If the negligence (injury) is not discovered within the first year, sometimes the statute is longer than one year. This is entirely dependent upon whether we are talking about a limitation upon the mother's cause of action or the child's cause of action. Generally speaking, either injured party has a year from the date of discovery of the injury to bring a case, although you should seek competent legal advice immediately regarding the date the year began to run (date of "discovery") and special considerations for the minor child's claim, if one exists.
